My bankruptcy was discharged in January 2010. However, there are 2 medical collections which appeared on my credit report in January 2011. I disputed the accounts with the Equifax but it responded stating that these debts are valid. But honestly speaking, these debts can’t be considered as valid as they were included in the bk. I even contacted the CA, who said that they reported the debts because it came to them after the bankruptcy filing was discharged for about 1 year. This is really very harassing for me. Do I just pay them off even though it was included in bk? I really don't want them on my credit report.
As your debts have been discharged in your bankruptcy filing, I don't think you should pay anything to the collection agencies. You should immediately contact your bankruptcy attorney and ask him to deal this matter. It is illegal for anyone to collect on any account which has been discharged on your bankruptcy filing.
Hi Jennah,
I agree with what Niicss has said. If the debts has been cleared off in your bankruptcy filing, then you won't be liable for paying off the debts any more. Moreover, it is illegal for the CA to harass you for those debts. I will suggest you to consider the opinion given by Niicss and contact your bankruptcy attorney in this regard.
Thanks
