Glad to find this forum! I started making payments on a chap 13 about 6 months ago, however now I want it dismissed because trustee is taking 2200 per month from my pay check which leaves me with barely enough to pay utilities and food. I'm a single mom and I just cannot handle it on a teachers salary. Is it difficult to get a case dismissed? Also, the most important items are my car and house that I am interested in saving. How do I do that if the case is dimissed??
If you do not follow the rules of the bankruptcy court, then your case can get dismissed. Also, your case can get dismissed if you stop paying the dues. Once your case gets dismissed, the lenders/creditors can immediately sue you for the dues. You should immediately get in touch with your car lender and mortgage lender and apply for repayment plans to pay off the loans. If they give you an affordable payment plan, you'll be able to save your property.
Thanks. Now I just need to figure out how to stop the automatic wage withholding the bankruptcy court set up. They sent it to my employer and my employer is deducting it from my pay.
