dismissed case after money given to the trustee

What are you options if you have given money to the trustee and the judge dismisses your case? I took a early retirement and used some of my retirement to pay off my bankruptcy. I contacted the trustee and was given the amount to pay and I paid it. Now they are saying they gave me the wrong amount and I owe another $57,000 after paying $57,000.00. Because I had to give my retirement pension to an investor as part of my retirement they will take 43% of the remaining $ I have that is just enough to cover it. So I would have retired to have nothing because all of my money was given to the trustee and financial planner. If they dismiss my case do they not owe me the $73,000.00 I've paid in total? At that point I can make arrangements to pay my debts to the creditors.

If your case is already dismissed by the judge, then I don't think you should pay any further money to the trustee. Bankruptcy dismissal will definitely affect your credit but I would rather suggest you to negotiate with the creditors and try to pay them off directly without taking the help of a trustee.

WHAT DO I DO IF THEY ARE SAYING IF I DON'T PAY THE REMAINING $ THEN MY BANKRUPTCY WILL BE DISMISSED? IF THIS HAPPENS WILL THEY GIVE ME THE $ PAID SINCE THEY DISMISSED IT?

Hi jay,

If you can afford to pay the money, then you should pay them. Otherwise there are high chances that your bankruptcy will be dismissed. As far as I know, you will not get the money back. The money that you paid to the trustee will have to be distributed to the creditors according to the priority if the bankruptcy is dismissed.
