had my bk 7 dismissed because i didn;t pay remainder part of filing fee on time i had a partial waiver. what do i do now?
Hi danny b,
When you file bankruptcy, the automatic stay comes into effect. However, as soon as the bankruptcy gets dismissed, the automatic stay gets revoked. As a result, the creditors, collection agencies, and lenders will now be able to continue with the collection process.
However, if your bankruptcy gets dismissed, you have the option to refile the bankruptcy. One thing that you should keep in mind is that if you refile within one year of dismissal of bankruptcy, the automatic stay will stay into effect only for 30 days. You thus, will have to file a motion to extend the stay after refiling the bankruptcy.
Thanks,
Sandra

thanks. wrote a letter to the judge for another shot at filing fee payment i missed. hoping so,but seems like the bk court is a little more friendlier to the creditors in my experience with them. thanks for your input
