i am divorced and my ex is considering filing bankruptcy one the first mortgage not second...my ex holds the 1st mortgage in his name only but i hold the second with him as a secondary. he is thinking of filing bankruptcy i don't want to ruin my credit. i can keep paying the second. is the bankruptcy going to reflect on my credit. i can't talk him out of it and my name is on the title and deed to the house
Hi kitten,
Though your name is on the title of the property, as you are the co-borrower of the loan, I don't think your credit will be affected if your ex files bankruptcy. However, you can still consult a bankruptcy attorney and take his opinion regarding this.
Thanks.

I want to file bankruptcy. Im the co-borrower on the house and my ex-husband is the borrower. He is aware that I want to file bankruptcy and wants to know what he has to do so I can file bankruptcy.
hi lawanna,
i guess your ex-husband is not filing bankruptcy jointly with you. in that case, he doesn't need to do anything in regards to the mortgage. however, you can contact your bankruptcy attorney and take his opinion in this matter. he may assist you further in knowing whether or not your ex-husband needs to do anything in this matter.
thanks
