Can we file bankruptcy to eliminate 1st and 2nd mortagage debt after forclosure?

I lost my job back in '08 and the salary I am making now is half of what I've been making. We just recently forclosed walked away from our home in Nevada and had 2 mortgages from the same lender (Wells Fargo Financial). Just as we were trying to do a modification (in-house, HAMP, etc.) we found out that our 2nd mortgage was charged off... the sheriff's sale was supposedly held on Aug 31st. We haven't received anything whether the house was sold and such. We have moved into a rental and have no other properties that we own. Can we file bankruptcy to wash away our debt? When should we file? the 1st mortgage had 190k and the 2nd had 95k... we just want to start fresh and move forward w/out this hanging over our heads. Thanks in advance for your help.

as you have already gone through foreclosure, and now wish to file a bankruptcy, then you are advised to file a chapter 7 bk so that you can start with a fresh 'stats'.
