I just recently found out that my disabled father put my name

Posted on: 22nd Dec, 2009 12:51 pm
I just recently found out that my disabled father put my name on his house w/o my knowledge, I am in a financial crisis now due to a divorce and may have to file bankruptcy. Will my disabled father lose his house even if I was unaware that he put my name on it?...Okay here is the deal, my exhusband had a truck repoed that had my name on it. He will not answer his phone so they are coming after me to pay this. I have been trying to make the payments but after the birth of my twin girls and having two other children I don't see any light at the end of the tunnel. In talking to my father regarding my situation I found out that he had put my name on his house with out my knowledge. He house isn't worth much but is paid for. He apparently put my name on his house thinking that if anything ever happened to him then it would be better to have my name on his house as well. I never signed anything to have my name put on his house. My question is.... if I file bankruptcy will my father lose his house. I also have a rental property that is paid for in full that isn't worth much, but would rather lose that then think of my dad possibly losing his house because of me.
Hi houstj_work!

Welcome to forums!

If you file bankruptcy, you will have to list all your assets in it. Thus, you will have to list your father's property as you are one of the co-owners of the property. The property is free and clear and there are chances that the trustee will sell it off to pay off your creditors. If you transfer the property back to your father now, you won't be able to file bankruptcy immediately as the property transfer will be considered illegal. I would suggest you to speak to your bankruptcy attorney and get his opinion in this regard.

Feel free to ask if you've further queries.
