Can you file bankruptcy after you have already been foreclosed on

Posted on: 10th Jun, 2009 05:58 am
we were told by a lawyer if we wanted to file bankruptcy to stop paying on anything that had to do with our house and see who foreclosed on us first, our mortgage or home equity loan. so we waited and waited and a year went by and we called our lawyer again to see what we should do and she asked us if any one was knocking on our door hounding us and we said no, so she told us to just wait. so now it's been almost 2 years and we have all this debt out there and still haven't filed bankruptcy and spoke to a different lawyer land was told we got really bad advise that we should have filed immediately. now what do we do? is it too late to file?
Hi what i would do is check out the state laws but i see nothing wrong with it i want to say your attorney is wrong, foreclosure is a prime reason for chapter 7.

Nope. Never too late to file. Banks are not foreclosing as fast as they once worth, with the amount of foreclosures out there. As long as they know someone is in the home, they will let people live there for a long time nowadays without a payment. File bankruptcy. Don't wait. They cost a lot nowadays since the bankruptcy law change.
