filing ch.7 bankruptcy i have half interest with my brother our parents home of which he agreed that me and my 2 small kids live in. can the trustee sell my home?

please help!! im currently filing ch.7 and im a registered nurse,just got thru chemo. txs for breast cancer,newly divorced with 2 small children. yes i continue to work but has been extremly difficult. went to court and trustee sent a realitor to my house, she claims i have enough equity in the house so she wants to sell it! my brother and i WILL NOT SELL, can i convert this into a ch.13? or do something to keep my parents home!? would the trustee really kick me and my kids out!!! what alternatives is there????

You can contact your bankruptcy attorney and check out if you meet all the required criteria to change your bankruptcy filing into Chapter 13. If you are able to convert your bankruptcy to Chapter 13 bankruptcy, it will help you in saving your property from your creditors.

i have a house i want to forclose on and i currently live in my parents, who passed away, their house. can i convert to a ch 13 and pay on the remaining debt and forclose on my previous house?

welcome to mortgage fit,

directly jumping to foreclosure & bankruptcy may spoil your credit score.but if you can ask your lender (your own home not parent's) to go for dil (deed in lieu of foreclosure) then you may at least save some of your credit score.

although chapter 13 is also a good option as you could be able to keep your parent's house and at the same time get relieved from the burden of paying both the mortgages.
