Chapter 7 Bankruptcy - should I file quit-claim deed first?

Posted on: 26th Jun, 2010 11:46 am
i am presently 3 months into a 1yr separation to divorce. we have a home in both of our names that neither lives in (currently vacant). it is eventually going to be in foreclosure but the bank has not yet moved forward with any proceedings. i am moving to nc from sc next month.
in order for me to file chapter 7 (i qualify based on my income over the last 6 months), should i issue a quit claim deed to my x-husband, removing my interest in the property so that my debt through the mortgage can be considered in my chapter 7 filing?
i no longer live in the home and am unable to move back in or maintain the property. i cannot have my chapter 7 filing obligate me to live in the home.
Hi LTSC,

Any kind of property transfer just before bankruptcy filing will be considered as fraudulent by the bankruptcy trustee. I would suggest you to contact your bankruptcy attorney and discuss your situation. He will be the best to let you know whether or not you should transfer the property to your ex-husband.

Thanks
