I filed BK in 2009, my mortgage was included. Bk was discharged in Dec. 2009. Now they want to file a foreclosure in Oct 2010. They never filed for foreclosure prior to BK nor during. This is the first notice (a processor served me Friday) I have not lived in the house since 2008. Can they do this and will it show up on my credit report. They have had possession of the home since 2008.

Though you filed bankruptcy and got a discharge, the lender still holds the lien on the property. In order to recover his lien, the lender can foreclose the property. However, he won't be able to come after you in order to recover the balance amount resulting from the property sale as the mortgage has been discharged in your bankruptcy filing. There are chances that the foreclosure will have a negative affect on your credit report.
