Getting names off mortgage after filing bankruptcy

In 2009 my husband and I filed bankruptcy and listed our rental property in the bankruptcy. Later we learned that the house was due to be foreclosed on, it was never foreclosed on. Our names are still on the property even though the lender locked us out of the property. We just learned this year that until our names are removed that as far as the county that the house is in says that we still own the property. The attorney listed for the foreclosure sale will not talk with us. What steps do we take to get this resolve. We still get bills for the maintance of the property and someone is stealing the water from the property and the water company says we are responsible. Until this month we had not been on the property because we did not know it was still in our name

Unless the property is foreclosed and removed from your names, you will be liable for the maintenance of the property. You can surrender the property to the lender in order to get rid of it. You can even ask the lender to sell off the property asap so that you are not considered liable for it.

I agree with James. Unless the lender sells off the property asap, you won't be able to get rid of the property.
