Loan modification

Posted on: 04th Oct, 2010 01:45 pm
I am in Chapter 13 and was just declared permanently disabled. Should I contact my mortgage company to see if I can get a loan modification? Should I contact my attorney and apply for a hardship discharge and then talk to my mortgage company for a loan modification as I will have enough fund with SSD and a private long term disability to pay the mortgage. Or should I just file for the hardship and await eviction? Thanks
Hi mlsweeney!

Welcome to forums!

As you're in Chapter 13 now, the lender will not be ready to modify your loan until you receive a discharge from the bankruptcy court. You will have to speak to your attorney and find out if you can get a hardship discharge. Once you're discharged of bankruptcy filing, you can contact the lender for a loan modification.

Feel free to ask if you've further queries.
