Chapter 13 Hardship Discharge

after my chapter 13 bankruptcy plan has started and i am not able to continue then how can i get a hardship discharge and when the court will allow it.
i am presently paying on a chapter 13 and have paid about half of the debt off,i owe now only unsecured debts , however i have been diagnosed with inoperable lung cancer dont know how long i can work due this ? i am facing forecloser can the mortgage company put me out ?

Hi jack,

If you're paying the dues on time as per your Chapter 13 payment plan, then the lender won't foreclose the property. However, if you sop paying the dues on time, then your bankruptcy filing can be dismissed and your property can be foreclosed.

As you're facing a hardship due to your illness, you should contact the bankruptcy court and apply for a hardship discharge.

My Chapter 13 has been recomfirmed sererval times and still has not reached a comfirm final. My payment has been raised and I hope to keep my car and house. I had a Chapter 7 years ago because of permanent job injury. I should be able maybe to change to a ch 7 in March 2011. What do I need to do for this ch 13 hardship to hopely keep from losing my home and all? I am on a disablity fixed income for the rest of my life.
