Declared BK and was discharged back in May 2009. Did not sign reaffirmation letter by lawyer's advice.
I have not made a mortgage payment since April (it's been six months) and mortgage co. has not been in touch with me regarding my payments. I fear the house is going into foreclosure and I want to keep my home. I called the bank to come to an agreement regarding monthly payments (modification) for my house has lost half of its value.
Where do I stand with the bank since I have not made payments? If I did not reaffirm the debt why does the mortg. co. still comes after you if by law it does not belongs to mortg. co. anylonger, or it does?
How can I proceed to my advantage?

your confusion is clear, mary. your question that states: "why does the mortgage co. still come(s) after you if by law it does not belong to mortgage co. any longer, or it does?" is going to confuse all of the rest of us as well.

if you have paid nothing in 6 months, i have to imagine the lender will definitely seek a foreclosure. you apparently have also neglected to speak with them. what are you referring to when you say "by law" they don't "own" "it" now? is this something you got from your lawyer?

speaking of your lawyer, why haven't you received all your answers from said lawyer?
