Dyck O Neal question

I recently filed for bankruptcy. A couple of years ago Dyck O' Neal took over as the loan servicer on a Homesaver Advance note I signed with GMAC. The amount is for about $6000. I have kept my home in the bankruptcy and have continued to pay my mortgage on time as agreed, but am confused as to whether I need to continue payments to Dyck O Neal. I have not received any communication from them since the filing but statements from them have always been erratic. They are extremely difficult to deal with as others have stated on here, as they are very disorganized and do not seem to have a clue. Any advice or should I call my attorney?

If you had not included the property and the mortgage in your bankruptcy filing, then you're responsible for paying the mortgage dues on time. If you don't do so, the lender will foreclose the property and you'll be liable for paying the deficient balance. You should contact your lender and ask them to provide you with all the required statements regarding your mortgage payment.

HomeSave Advance loans are unsecured, which means they are not secured by your property. Many people quit paying them and at some point (sometimes after a year of non-payment), they will contact you and either offer a settlement amount of less than you owe...or suggest that YOU offer a settlement amount. Dyck O'Neal cannot foreclosure on your property. As always, check with a knowledgeable attorney...

A little over a year ago GMAC offered me a home saver loan when I got into trouble with my mortgage my wife was laid off from her job and we fell behind by 2 months. They assigned the loan to Dyck- O'neal and these people are horrible to deal with, they never send statements ontime or at all and I have paid them throught thier online payment service but 1 out of every 3 they say they are not getting and they say its my problem even though I have a printout of the transaction. The balance is around $4000.00 but I am now able to pay more and I've doubled the payments but it doesn't seem like I'm getting ahead.

Welcome to forums!

You should contact your lender and request them to withdraw the account from collections. Once the lender withdraws the account from collections, you'll be able to pay off the debts to the lender. This will help you in sorting out the matter. But it will depend upon the lender whether or not he will consider your request.
