house not included in bankruptcy

Posted on: 22nd May, 2010 07:05 pm
We filed for bankruptcy in 2007. At the time, we intentionally excluded our first and second mortgages, hoping we would be able to continue paying them off.

Turns out, we weren't able to. Our house is in foreclosure and, despite having a reasonable offer, the mortgage company won't approve the short sale. Can be go back to the bankruptcy court and ask for the mortgages to be included?
Hi mb,

If your bankruptcy filing has been already discharged, then I don't think you would be able to reopen it and include your mortgages into it. However, I would suggest you to contact your bankruptcy attorney and take his opinion in this regard.

Take care.
