Does my boyfriends income count on my chapter 7?

i had a lawyer tell me that my boyfriend's income would need to be reported on my chapter 7 bankruptcy since he provides part of my support even though i pay bills. i am on social security.

my question is this, why? isn't social security exempt? and if so, how can i be ordered to pay anything for bills? i don't have control of my boyfriends money. our accounts are separate and we don't give one another access to the other or use it.

second, he doesn't make very much money. it's a low amount. our combined income would be lower than the median income, much lower. will they order me to pay because of his income? he doesn't have assets either.

The bankruptcy court will not be able to touch your social security income. As far as I know, it is exempt from any kind of garnishment. However, it doesn't seem correct to me that you need to report your boyfriend's income in your bankruptcy filing. I would suggest you to contact another bankruptcy attorney and take his opinion in this regard.

You are right that bankruptcy court will not touch your social security income.
If you are not filling bankruptcy jointly with your boyfriend then you don't have to include your boyfriend for chapter7. Your income,debts and assets will be considered while you apply for bankruptcy. The best person to give you detailed information would be a bankruptcy attorney.
