Posted on: 24th Nov, 2010 11:58 am
i am in the process of divorce. i have been very ill for several years and can not work. my wife just wants me out of her life. i have no way to pay my debts so i am considering filing bankruptcy. what happens to the mortgage that has both our names on it? i do not want any thing out of the house or our belongings. can i fill and get out from under the mortgage? i have no income no disability payments nothing!

do not know where to start or end this nightmare
Welcome cmeliving,

If you file bankruptcy and include the mortgage in it, then you will get a discharge from it. You won't be personally liable for the mortgage dues once the mortgage is discharged.
