What happens to my IRA when I go bankrupt?

Posted on: 03rd Aug, 2009 08:04 am
i need to declare bankruptcy but have $6300 in an employer sponsored 401k which i will be rolling over to an ira at my bank because i have been recently laid off. i co-own a house with my fiance and we have a joint checking account. what happens to her? my name is on the note with her. can my ira be taken? does my fiance have to file bankruptcy because the creditors will attach the house for payment on me?
please consult with a bankruptcy attorney. these are questions best asked, and answered, by someone with that kind of expertise.
