Our orginator was FreddieMae, the home mortgage company (servicer?)rushed to foreclosure and the property was "sold" to them. At the time of the sale, the tax value was & still is higher than the amount they brought & the current list price of the house. We had a 2nd mortgage with this company and they are calling to collect on the 2nd mortgage indicating they are separate from the parent company (even though they have the same name), didn't the parent company have to clear the lien prior to buying & listing the property?
Also, we have another 2nd mortgage holder who is threatening a judgment even after they listied the loan as charged off on our statement. We are currently living in another state, can we file bankrupcy to survive this :?:

as you are the borrower of the loan, it is your responsibility to pay off the dues and not that of the parent company.
if the second mortgage lender has charged off the loan, then he won't be able to sue you for the dues. it is the collection agency who will contact you for the dues.
as far as filing bankruptcy is concerned, you should get in touch with a bankruptcy attorney and take his opinion in this matter. he will be the best to help you regarding the whole situation.
