My house was due to be sold 5/18 and I filed Ch. 7 two weeks ago. My attorney said GMAC just has to go to court and get the automatic stay lifted and set a new sale date. He said all of that usually takes about 30 days. So far, they have not started that process.
Has anyone done this and if so, what sort of timeframe did you get for the new sale date? I'm trying to figure out how long I will have to move. My attorney just says, "don't worry about it." Easy for him to say; he has a home.
I know they don't have to go through the whole 90 day (Arizona) waiting period again, but I can't seem to find out how often they actually hold the auctions.

As far as I know, it takes around 30 days to lift an automatic stay. The lender will have apply for the lifting of the automatic stay in the court. The court will look into the matter and decide whether or not they would lift the stay.
