Husband filing bankruptcy

[size=18:b1eef50f67][/size:b1eef50f67] my ex husband is going to file bankruptcy. his name is on the mortgage but not on the deed. he quit claimed his name off two years ago.

i cannot afford to refinance the house at this point. (i am living in the house and paying the mortgage.) my income is not high enough. i am in school to get a higher nursing degree and should be able to refinance in another year or so hopefully.

is there anyway he can file for bankruptcy that will not affect my mortgage? what options does he have...is there any 100 percent way to safeguard my home?
Is your name of mortgage?

if yes, discuss it with your Ex & finalize some formula for mortgage payment for another one yr.

if not, you need not to worry as you are independent owner of house

Hi Jennifer,

What type of bankruptcy is you ex filing? If he files for Chapter 13 bankruptcy and does not include the mortgage in it, then your property and mortgage would be safe. You can keep on making the payments for the next 1 year and then refinance it in your name.
