I filed Chp 7 Bk and included my house which is upside down with the mortgage. I am married and husband did not file with me. He is not the primary bread winner and he is also on the mortgage. I would like to keep the house but unsure how to go about it. The bank has not yet filed forclosure. Can I quit claim the house in his name only and have him continue making payments or negotiate for a modification.
Welcome smortimer,

You have mentioned that you've included the house and the mortgage in your bankruptcy filing. In such a situation, you won't be able to quit claim it to your husband. It can be considered as a fraud if you do so.
