Mortage pymnts after chapter 13 discharge

Posted on: 08th Apr, 2010 04:23 pm
We paid off our Bankruptcy to the trustee in 10/09', the trustee did not distibute the monies til 1/10 in the mean time I called my mortage company asking them if I should send in my payments due the fact I recv'd no statement they forwarded me to the "bankrutcy dep." because my account was still considered in bankruptcy. Called again in Feb.10 was told by my mortage company br dept. that my account was now in accounting and they would be sending me a statement once they updated my account and released it from bankrupcty. My bc was finally discharged on 3/1/10, and today I get a phone call from my mortage company stating I owe $8k from back to 11/09 and they are going to foreclose. Am I responsible and if I walk can they come after me they made a comment that they could come after the property but no us personally. Is that true?
Hi oberry!

Welcome to forums!

If you made the payments on time to the lender, then he won't be able to charge you with the back payments. All your dues should have been included in the payments given by them. Rather than walking away from the property, I would suggest you to have a word with your bankruptcy attorney and the lender and clarify the whole issue. You should also send the required bankruptcy discharge documents to the lender and let him know that you're not personally liable for the payments anymore.

Feel free to ask if you've further queries.
