Medical bills not added to bankruptcy

Posted on: 04th Apr, 2012 02:43 am
Hi there… I filed for Chapter 7 protection along with my wife few days back. It is not that I had immense debt problems however the garnishment would have reversed my ability to continue paying my bills on time. Apart from this, my wife is unemployed and we have 2 children. Anyway I have a question about going forward in respect to medical bills. My attorney did not list the bills that I had with me when we did the paperwork and only added my mortgage, car note and the garnishment. What do I do about this?
Hi Shakers,

The medical bills should have been included in your bankruptcy filing. It is surprising that the bankruptcy attorney did not include them in your bankruptcy filing. You should once again ask the attorney to add them in your bankruptcy filing. In case he doesn't add, you need to mention the medical bills when you go for the hearing.

Take care.

Hi Shakers!

Welcome to forums!

I agree with Sara's opinion here. The medical bills should have been included in your bankruptcy filing. You should contact your bankruptcy attorney immediately and ask him to add them to your bankruptcy filing or else your bankruptcy filing may get dismissed.

Feel free to ask if you've further queries.

Why did your Attorney say he didn't list the medical bills? That doesn't make sense - there must be a reason. Or you've got a very bad Attorney
