I filed for Bankcruptcy and my mortgage is asking for reaffirmation papers

Posted on: 26th Mar, 2010 03:15 pm
I filed for Bankruptcy and my lawyer said that I can keep my
house as long as I pay the mortgage he knows I am 2 months
behind. I got my bankruptcy papers today saying when I
have to go to court.

Then I also received a notice from my mortgage co Chase
saying that I have to reaffirm. When I called my attorneys
office I was told that they usually tell people NOT to sign
the reaffirmation papers.

I have been trying to get a Mortgage Modification since
June of 2009. I call every week and I was told this time
that they have everything and are looking at it. It is so
frustrating, I was up to date on my payments BEFORE I
asked for the modification.

I am confused and I don't want to lose my house,

Any help would be great
Thanks
Patti
Hi patchina!

Welcome to forums!

Reaffirmation of the mortgage dues will make you liable for the it once again. That's the reason why your attorney has asked you not to sign the papers. However, as you want to save the property, then it will be a good option to sign the papers.

As far as the loan modification is concerned, the process will get stopped now as you're in bankruptcy. However, after you reaffirm your debts, you can reapply for the modification.

Feel free to ask if you've further queries.
