im in a modify trial now and i want to file bankruptcy on my credit cards and my truck can i do this and can i keep my truck
It is better to be in the modification now before you file bankruptcy; if your full modification is approved, you would most likely be able to reaffirm it in the bankruptcy. If it is denied, you will have another opportunity to have the payment negotiated or reduced, so in effect, you'll have two chances for a loan modification.
In regard to the bankruptcy filing and keeping your truck, your bankruptcy attorney would be able to fill you in on the rules and regulations that govern what you can keep and what is discharged subject to the type of bankruptcy petition you file ( Chapter 7 or 13 ) and your specific financial situation.
