is he planning to include this property in the bankruptcy? if yes, then there are chances that you will have to move out of the property. however, if files chapter 7 bankruptcy and reaffirms the mortgage, then you won't have to leave the house if he regularly makes the payments.

who is makign the paymnets? Is he willing to give a quite claim on the property?

If you can afford to make loan payments and if he can give you a quite claim, then you may be able retain the house.

Hi, Thank you for the responses. He was making the payments but has stopped. we are now behind 2 months and I believe he wants to include the property. I just need to know what recourse if any I have as I am on the deed and am willing to work with the mortgage company to sustain payments. but I'm now a single income household.

probably see if in any way he is ready to give you quitcliaim and after that if you can refinance.
