No court order discharge paper to show

Posted on: 19th Jul, 2010 05:01 am
The mortgage loan was reported in my credit report and discharged in BK Chapter 7 in the Federal Court
with 0 balance. However, a 3rd party (not the original lender) filed a complaint of forclosure (the loan was transfered or bought by them from the second lender).
We responded to their demand letter and was ignored stating the violations of Fair Debt Collections. According to a BK case in Kansas since I was not present in the transactions my loan is legally dismissed. What is the next step? We have no lawyer but have someone helping us. I wish not to agree with the terms of signing a contract without the final clearance of the deed.
Please e-mail me my response and not show my name.
Hi tessierobb!

Welcome to forums!

Unless you have a discharge letter from the court, you won't be able to dispute with the 3rd party regarding the complaint of foreclosure. You should contact the person who is helping you regarding bankruptcy and check out as to how you could receive the discharge letter from the court.

Feel free to ask if you've further queries.

Can we show the discharge report from Credit Report (Experian)?

Thanks

Hi Tessie,

You may show the discharge report from Experian but I doubt whether or not the 3rd party will consider that report. If would have been better if you had the discharge report from the bankruptcy court itself.

Thanks,

Jerry
