Would Chase Mortgage still negotiate my settlement offer for my 2nd mortgage i have with them, while i'm in the process of filling for bankruptcy? The Bankruptcy department at chase said they will need a discharge before they can negotiate with me. I did not include the 2nd Mortgage in the bankruptcy... I just spoke to my attorney and he said i will not receive the discharge till about four months after my hearing.

Well, you are filing for BK for your first loan with chase mortgage.So subsequently they will only negotiate for the 2nd mortgage once you give them discharge.

No I am not filling for BK for my 1st Mortgage, just all my CC debt. I've been trying to get a settlement on my 2nd, but now they say they will not negotiate with me till i get a discharge... Anyway I can go around that..

as you are filing bankruptcy, the court will issue an automatic stay on all your creditors and they won't be able to contact you for any dues. thus, the second mortgage lender will not be able to negotiate with you for the dues. once the bankruptcy filing gets discharged, you will be able to negotiate with the second lender.
