responsibility or not

me and my ex husband bought a house together. we got devorced and he kept the house but my name stayed on it.
i filed bankrupsy and put the house on that. he has just passed away and my name still on this home am i now responcible for the house?
was the house affirmedn in the BK? If it wasn't then it is not your issue...

Hi,

Welcome to the forum.

You and your ex-husband were joint owner of the house even after your divorce. So as you ex has passed away now you are the sole owner of the property.

By the way is it a mortgaged property? If so are you on the mortgage?

Hello Lisa,

If you have a mortgage against the property in your name and if the debt is not discharged in the bankruptcy, then you are still legally responsible to pay that off.

Did you file bankruptcy Ch 7?

There are too many variables to answer your question.

First, what does your divorce judgment say?

Second, what does your bankruptcy judgment say?

Third, who are the heirs of your husband's estate, and is there a probate?

Hi Lisa,

If you were on the title of the property then yes you would own the house. Is there equity in the property? If you ex has recently passed I'm sure it has to go through probate court to make it official on who gets the property. In the meantime, you will have to deal with the property if it is still in your name. Again, if there is equity in the property, it might be worth holding on to.
