Our home is in a pending short sale. We are also currently in BK. But my husband signed something allowing the short sale. can we still save our home? The offer is low and we can make the payments now. Can the BK still stop the short sale? We are 1 year behind on property taxes. If not how much time do we have in the home? We have a second that needs approval and the buyer needs a second.
Hi Guest,
As you're in bankruptcy, the lender will not be able to short sale now. However, after the discharge, the lender can sell off the property as your husband has signed an agreement giving the lender the right to short sale the property. Once the property is sold off, you'll get an eviction notice and you'll have to leave the property within the time period as mentioned in the notice.
Thanks,
Jerry
