Our bankruptcy discharged in 2001 and we did not reaffirm the home loan, the morgage company never reclaimed the property and since then it has been distroyed. Now in 2010 they sold the loan to another company and the new company contacted us by mail not to expect payment but to reclaim the property. Is there a statute of limitation on how long they have to reclaim the property form us?
Hi clairemincks,
I haven't heard of any such statute of limitations regarding claiming of the property after bankruptcy. In my opinion, you should contact the your bankruptcy attorney and check out his opinion in this regard.
Thanks,
Jerry
