I was checking my credit yesterday and discovered my mortgage was not reporting. I called them today and they informed me it was still in bankruptcy. This bankruptcy closed in Feb. of 2006 and I reaffirmed the mortgage. My mortgage company informed me the judge denied the reaffirmation. What does this mean? Do I own the house and how do I get it reaffirmed?
Your mortgage company has to also agree to the reaffirmation. The judge does have the final say if the mortgage is reaffirmed or not as well.
Some bankruptsy law states that they cannot take the property if your payments are on time.
I really would contact the attorney that handled your bankruptsy for you.

Well Elnora, you're right. The judge does have the final say in a reaffirmation after bankruptcy filing. But depending upon the type of bankruptcy that nhargiss has filed, he may or may not able to keep the home.
Nhargiss, you'd have to check out the state laws or have a talk with your bankruptcy attorney. By the way, which chapter did you file?
Good luck

our bankruptcy was dischared and we signed a reaffirmation letter and the judge denied it. what does this mean now?
Hi LisaAnn,
I guess though your bankruptcy filing was discharged, the judge did not agree to let you reaffirm the loan. It means that you're not personally liable for the mortgage payments. You can surrender the property to the lender and he will foreclose the property to recover the debts.
