My ex husband file bankruptcy against the mortgage on my home after our divorce was final. I was awarded the house in our divorce and have since had his name removed from the property. The problem at hand is that he's pushing for an assumption mortgage on my part. I've tried to get a loan mod and refi but my income isn't enough to get approved. My payments have all been on time since I took over the responsibility 6 years ago. My credit score is 735 and I have savings to help back my payments up until I can get a better job. Do I have any options?

Has your husband included the mortgage in his bankruptcy filing? If yes, then he won't be liable for the mortgage dues any longer. You will have to assume the loan and pay off the dues to save the property. You can apply for a loan assumption. However, as far as I know, in this case as well, the lenders will check your income and credit score.

i want to file a assumption to get a co borrower of the loan then i want to file bankruptacy on the house

You can contact the lender in order to get a loan assumption. However, not all lenders will be ready to let you assume the mortgage. You should contact your lender and check out if you will be able to assume the mortgage.
