I claimed bankruptcy which was finialized in Jaqnuary 2009 and included my property. I'm currently seperated & not living there. My ex is still making the payment and I am the only one on both the title and morgage. I was told that I am still liable. I don't want anything to do with it. How can I remove myself from this property completely?
Thank you
Thank you
hi my,
it would be difficult for you to remove your name from the property and the mortgage as you've claimed bankruptcy on that property. it is correct as your name is on the property and mortgage, you would be responsible for the payments. if your ex stops the payments, the lender may foreclose it which will affect your credit.
you can ask your ex to refinance the property in his/her name. this may help you in removing your name from both the loan and property. however, it would be the lender's discretion whether or not he would refinance.
