Is it possible to remove my name from the deed?

i currently live in a home that has my sister, brother-in-law and my name on the deed. they are selling the house and i am going to be filing bankruptcy. i don't want the house to interfere with my bankruptcy filing. is it possible to remove my name from the deed?
Yes, you can remove your name from the deed. But why do you want to file bankruptcy? it's going to affect your credit and you'll lose around 200-300 points. Can you tell me what's your exact situation? may be I can guide you in a better way.

Hi susan,

Your boyfriend needs to sign a reverse quitclaim deed in your name. This will remove his name from the property. Once he does this, the deed has to be notarized and recorded at the county recorder's office.

I have a small business which is seasonal but in both my wife & i names , Iam not involved personally but will like to remove my name from the business , how do i do this and do i have to get her involved

Hi Perry,

As far as I know, a quitclaim deed can be used only to transfer a real estate from one person to another. I don't think you will be able to transfer a business with that deed. I think you should consult an attorney and get his opinion on transferring a business.

I currently live in a apartment for last 5 years, and now I plan to buy a house. But when I applied for a mortgage few months ago, I was told by my bank that I won't be qualified for a loan as long as my name is on a house that my father owns.
Any suggestion?

Hi Nish,

You can sign a quitclaim deed and transfer the property to your father. This will help you removing your name from the property deed. However, you'll have to notarize and record the deed. Once this is done, I hope you'll be able to take a mortgage.

do both the grantor and grantee need to sign and notorize a quit claim

Though the signatures of the grantors are required in the deed, not all states require the signature of the grantee. You will have to check out your state laws to know the rules followed in your state.

If I have a deed to a mobile home with a spouse for example Mr. John "or" Mrs. John, Can one spouse remove the other one off said deed without my consent or knowledge.

Both my parents and I are on the deed of their house. I also believe Im on the mortgage stmt.
Im buying a home with my fiance....how does this effect me?
Can I do a quick-claim deed? Do my parents need to show proof of income (neither of them work) and my dad just filed for bankrupcy

welcome maggie,

as your name is already on a mortgage doc, it will be difficult for you to qualify for another loan for a new property. a quitclaim deed will not help you in removing your name from the mortgage docs. it will help you in removing your name from the property deed only. in order to remove your name from the mortgage, your parents will have to refinance it. however, as your father has filed bankruptcy and they do not work, it would be difficult for him to refinance.

My ex-wife does not want to refinance the house to remove my name from the mortgage docs what other options do I have. Perhaps taking her to court? She does not want to refinance because she can't afford to but that is not my problem please advise what steps I can take to get my name off immediately as I am looking to purchase a house with my wife.

I hope your name is on the property deed. In that case, you can file a partition law suit at the court. With the court order, your property will be sold off and the loan would be paid off. If there is any excess amount, then it would be distributed amongst both of you.
