Chapter 13 Bankruptcy Repayment

My husband and I are separated, but still legally married. We owe back taxes for federal and state. My ex-husband's wages have been garnished for the federal taxes and they have just started garnishing my wages for state. The only way that we can see clear is to file Chapter 13. Should my ex and I file bankrutpcy together or separately since we jointly owe the taxes? Can we BOTH repay the play via payroll deduction or will they take the entire amount from only one of us?

You cannot file bankruptcy in order to get rid of the federal and state back taxes. Bankruptcy will not help you get these back taxes discharged. You will have to pay them in full.
