i filed a chap 7 got my discharge in march 2010, last year got a home loan modification and also put the home on the chap 7 but we want to keep the home we fell behind two months now the mort company wants us current and we cant do it yet but we can keep paying on time they stop sending statments but they cashed the last two payments i sent in the last two months , we never made any deal after the discharge so they want us current can they take the home anytime if i stay 2 payments behind,or can we just stop paying them so we can save money to move some where cheaper and how long will it take them to kick us out,and can they make me pay for this upside down mortgage, wow stressed
As you haven't reaffirmed the mortgage, you won't be liable for the mortgage dues. If you walkaway from the property, then the lender can foreclose it but won't be able to come after you for the dues. You can stop making the payments and get rid of the property.
