Bankruptcy and Refinance

Posted on: 12th Jan, 2011 06:45 pm
I currently have a mortgage in my name only, however, my husband's name is on the title. He has field bankruptcy..ch 7. As part of that, the bk trustee has agreed to a settlement for my husbands portion of ownership in the house. We plan to record a quitclaim deed once we complete the trustee agreement. The quitclaim deed is filled out but we are waiting to record it. I am also in the process of refinancing my existing mortgage. The paperwork from the title company came back with my husband's name on the title...and his name on the mortgage papers. I did not have him sign them as I don't want to affect his bankruptcy settlement and I don't want his name on the mortgage or on the title. What can I do?
Forgot to mention...we live in Michigan (property and bankruptcy are in Michigan)

hi nnb!

welcome to forums!

as your husband is filing bankruptcy, you or your husband should not try to transfer the property to anyone else. this can jeopardize your husband's bankruptcy filing. he may have to wait for a year in order to file bankruptcy.

feel free to ask if you've further queries.
