if i file for bankruptcy, can unsecured creditors file a lean against my primary home? my primary home is in mine and another (unrelated) person's name.
surely they will come behind your primary home.but BK should be your last resort when it comes to negotiation.
They may not be directly go for the property takeover or foreclosure because they have no legal proofs to do so, but surely they can harass you and can put a remark on your credit report.

Hi michcosg,
As far as I know, once the court passes a discharge order releasing the debtor from personal liability to pay off the debt, it stops the creditors from taking any collection action against you and placing liens on the property. However, much also depends on what type of bankrutcy you are filing.
