I am in the process of claiming bankrupcy. I chose to forclose on my mortgage since I was so upside down. How long do I need to wait to get a new mortgage?

After a foreclosure, you will have to wait for 3-4 years in order to get a mortgage. As far as bankruptcy is concerned, getting a mortgage will depend upon the chapter of bankruptcy that you file. In case of chapter 7, you will have to wait for 2 years to get a FHA loan and 4 years to get a conventional loan. In case of Chapter 13, you need to wait for 1 year to get a FHA loan and 2 years to get a conventional loan.

My sister signed for a mortgage for her son about 5 years ago. He recently passed away and she cannot afford to make the monthly payments. Can she file bankruptcy on the mortgage and just give up the property

rather than filing bankruptcy, she can apply for a deed in lieu of foreclosure in order to get rid of the property. this will not only help her in selling off the property but she will not be liable for paying the deficient balance resulting from the property sale.
