I filed bankruptcy 06/2009 - it was discharged in 10/2009 - I was trying to get caught up on the mortgage and keep my house. However I now no longer have a job. I am now unable to make my payments. I live in Alaska. Can someone tell me if I walk away if the bank will sue me for the balance of the loan?

If you filed Chapter 7 and did not reaffirm your mortgage, then the lender will not be able to come after you for the deficient balance if you walkaway from the property.

I am still living in the house and have continued to make payments up to this month. I did not sign a new agreement. So now that I can't afford the payments any longer due to Job loss I can walk away and not fear for being sued?

As you haven't reaffirmed the mortgage, you will be able to walkaway from the property. The lender will foreclose it but he will not come after you for the balance dues.
