my wife and i are separated and will be divorced on 1/1/11. we have a joint mortgage payment until the house sells. she is considering filing bankruptcy so she won't have to pay her $1,000 per month portion to me. will the bankruptcy make it where she doesn't have to pay anymore? (at which point, i will be affected since i can't afford it on my own?
Welcome Guest,
If your wife includes the mortgage in her bankruptcy filing, then she can get discharged of it. Thus, she won't remain personally liable for the mortgage payments. So, the lender will not be able to come after her for the loan payments.
