My wife and I filed chaoter 7 and received a discharge in Sept of 2009. Our mortgage was included in the bankruptcy. Citimortgage was notifed and informed of the "meeting of the creditors", they failed to show or make a claim. We moved out of our house prior to the discharge, gave Citi notice that the house was vacant. Now in April 2010, they filed forclosure in county court and the court placed a judgement against us and it is listed on our report. The house goes to sheriffs sales in 2 weeks. Citi is now filing again to increase the amount of judgement ot cover interest. I thought this was illegal, this debt was discharged and now it is showing as a judgement.

As far as I know, if your mortgage was included in your bankruptcy filing and discharged, then the lender will not be able to come after you for the deficient amount. You should contact your lender and let them know about your bankruptcy discharge. You can even ask your bankruptcy attorney to have a word with your lender. If the property is foreclosed by the lender, then it would reduce your score by 250 points.
