My lender filed foreclosure in 12/09 on a the costruction loan of my home that is 70% complete.
I contested and file a Motion to dismiss in 2/10. In 6/10 my lender send me a letter indicating that they were going to charge off my mortage.
On 10/10 I filed an amendment to my original motion and requested a court date.
On 12/10 my lender filed a voluntary dimissal and on 2/11 I received a 1099C for the full amount of the loan.
What can I do to get clear title and remove their mortgage from the county records.

Unless you pay off the mortgage in full, you won't be able to receive a clear title or remove the mortgage from the county records.
