My Mom was in a nursing faciliy less than two years, she was in a tennessee nursing home and owned a home in Virginia, she also had a living will leaving the home to her four children when she passed away. She passed away in July 2008 and Medicaid says we need to give them the house but they have not placed a lein on the property and her children are having to pay for maintenance on the property but they cannot rent or sell the property. My questions are: can tennessee medicaid take propery from Virginia and if so how what is the time frame for Medicaid to place a lein on the prppery? This is really causing a lot of stress for all of us and my brother who is the executor has health problems and should not have to worry about this... Please help

In order to take over the property, the Medicaid has to get a judgment and place a lien against the property. I don't know the exact time period within which Medicaid can take over the property. You should contact an attorney and he may assist you in this regard.
