Will the IRS allowed deductions on taxes

i'm divorced. the court determined i am the sole owner of the property however the mortgage was in my ex-spouse name only. i have a quit claim title in my name for the property and pay the mortage and taxes. i tried to refinance but the ex appealed the decision and i am on hold. will the irs allow me to claim the mortgage interest and taxes.

Currently you are not on the mortgage but very soon planning to refinance.So if you can show them the proof that even though you are not on the mortgage,payments towards mortgage has been from your own checking/savings account.If you have the proofs to show it to them then i think there could be some hope.

It totally depend on the assessing officer...

Unless your name is mentioned on the mortgage docs, I don't think you'll be able to claim tax deductions for mortgage interest payments.
