Name change and the $8000 tax credit

Posted on: 19th Jan, 2011 11:09 am
I hope someone can help. Here's the scenario. I bought a house in May 2010. I qualified for the $8000 tax credit. I was also legally divorced and had my then married name changed back to my maiden name through the courts. I also followed the process of changing my name in Texas from notifying SSA to changing it on my drivers license, however during the time of closing the bank and title company told me that since my new picture id with my now maiden name hadn't come in just yet, that they would have to close under my married name even though I was legally divorced and single. They told me that I could change it later down the line. Well, in December I tried doing that. I went to the land and title company and they told me that I would need a real estate lawyer. Now I am getting ready to file my 2010 taxes and my question is, do I have to change my name on the deed to my maiden name before I do my taxes and will I lose or have to pay back the $8000 tax rebate that I already recieved
Hi falgout!

Welcome to forums!

It will be better if you could change your name on the deed to your maiden name before you do the taxes. Nevertheless, I will suggest you to contact a real estate attorney and a tax adviser and take their opinion in this regard.

Feel free to ask if you've further queries.
